{"id":1258,"date":"2022-03-22T19:22:51","date_gmt":"2022-03-22T19:22:51","guid":{"rendered":"https:\/\/www.degencpa-titan.com\/test\/?p=1258"},"modified":"2022-03-22T19:22:51","modified_gmt":"2022-03-22T19:22:51","slug":"how-to-get-a-patent","status":"publish","type":"post","link":"https:\/\/www.degencpa-titan.com\/test\/how-to-get-a-patent\/","title":{"rendered":"How to Get a Patent"},"content":{"rendered":"<p><span style=\"color: #000000;\">Have you invented the next big thing?\u00a0 Built a better mousetrap? \u00a0If you invent or discover a new and useful \u201cprocess, machine, manufacture, or composition thereof\u201d you can apply for a federal patent to protect your invention from being used by others without your permission.<\/span><\/p>\n<p><span style=\"color: #000000;\">Do you remember the first video arcade game, Pong? Invented by Atari, the game was a cultural phenomenon. Atari had the all-important first mover\u2019s advantage and should today be in the same league as X Box, Wii, and PlayStation, but is not. \u00a0Why? Because they waited too long to get a patent, and by the time they did, there were already knockoff Pong games on the market.<\/span><\/p>\n<p><span style=\"color: #000000;\">There are three BASIC types of patents:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Utility patents protect machines and industrial processes and last for 20 years.<\/span><\/li>\n<li><span style=\"color: #000000;\">Design patents protect designs of manufactured items and last for 14 years.<\/span><\/li>\n<li><span style=\"color: #000000;\">Plant design patents (rare) protect new plant varieties and last for 20 years.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">The overall process for acquiring a patent is:<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Research<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">The first thing to do is to go to the website for the United States patent and Trademark Office (USPTO) \u2013 <a style=\"color: #000000;\" href=\"http:\/\/www.uspto.gov\">www.uspto.gov<\/a>. There, you can do a quick search to see if there are any other exact inventions already patented.\u00a0 If there are similar patents out there, it may be that yours is different enough to still be patentable. Only a patent lawyer could tell you for sure. Expect to easily spend a few thousand dollars to have a patent lawyer research your invention and its protectability.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Submit a patent application<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Once you have decided that your invention is unique enough to warrant a patent, you need to hire an attorney to draft and file a patent application. Although some facets of what is known as Intellectual Property law can be done without the aid of attorney (trademark applications for example and copyrights), patents are complicated enough that expert legal help is required.<\/span><\/p>\n<p><span style=\"color: #000000;\">A patent application usually consists of:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">Drawings<\/span><\/li>\n<li><span style=\"color: #000000;\">An invention background (why your invention, even if similar to others, is still unique)<\/span><\/li>\n<li><span style=\"color: #000000;\">A summary of the invention (how the invention fills a need)<\/span><\/li>\n<li><span style=\"color: #000000;\">A detailed description of the \u201cembodiments\u201d of the invention (examples of the invention)<\/span><\/li>\n<li><span style=\"color: #000000;\">A set of claims (the scope of the requested patent), and<\/span><\/li>\n<li><span style=\"color: #000000;\">An abstract (a brief description of the invention)<\/span><\/li>\n<li><span style=\"color: #000000;\">Fees for search, examination, analysis, etc.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">After you file your application, it will take between six months to two years before you hear from the USPTO. Don\u2019t be discouraged if your application is rejected, as that often happens. Your lawyer will go back and explain to the patent office why their decision is wrong and should be reversed. Claims are usually rejected because:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">The language in the application was too vague<\/span><\/li>\n<li><span style=\"color: #000000;\">The description of the invention was insufficient<\/span><\/li>\n<li><span style=\"color: #000000;\">The invention is not unique enough<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><strong>File amendments if necessary<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">An amendment to your application may be necessary. After you file it\/them, you will either receive an approval, or a \u201cfinal rejection\u201d (only in the government is a \u201cfinal rejection\u201d not final and actually appealable.) If you receive an acceptance, or what is known as a \u201cpatent allowance\u201d, you will need to pay an issuance fee. \u00a0Other additional fees are required every few years.<\/span><\/p>\n<p><span style=\"color: #000000;\">Although this is a cumbersome and fairly expensive process, if you have in fact invented something unique, you need to protect it by obtaining a patent in order to help maximize the lifetime value of your creation.<\/span><\/p>\n<p style=\"text-align: center;\">***<\/p>\n<p style=\"text-align: center;\">Eric S.
